General Terms and Conditions
These terms describe the conditions that apply when you hire VOLUX Tak & Plåt AB for roofing and sheet metal work. They apply unless otherwise agreed in writing in the individual quote or contract. If you hire us as a private individual, the Swedish Consumer Services Act (konsumenttjänstlagen) also applies, and nothing in these terms limits the rights the Act gives you.
Quotes and contracts
Our quotes are free of charge and valid for [30] days from the date of the quote, unless otherwise stated. The quote specifies the work and materials included. The contract is entered into once you have accepted the quote in writing, for example by signing it or confirming by email. Any changes or additions to the contract must also be made in writing.
Right of withdrawal
If the contract is entered into outside our business premises, for example at your home, or at a distance by phone or online, you as a consumer have a 14-day right of withdrawal from the day the contract was entered into. If you want work to begin before the withdrawal period has expired, you must expressly request this. If you then withdraw, you pay for the part of the work already carried out.
Price and additional work
The price is stated in the quote, either as a fixed price or as an approximate price. If we have given an approximate price, it will not be exceeded by more than 15 percent, in accordance with the Consumer Services Act. During roofing work, hidden damage, such as rotten roof boarding, may only be discovered once the roof is opened. Such additional work is carried out only after we have informed you and received your approval, unless urgent measures are needed to prevent damage to the property.
Payment
Payment is made against invoice with [30] days’ payment terms, unless otherwise agreed. For larger projects, instalment payments may be agreed as the work progresses. In the event of late payment, interest is charged in accordance with the Swedish Interest Act (räntelagen), together with any statutory reminder fees. Payment must be made in a traceable way, for example by bank transfer.
ROT tax deduction
When the work qualifies for the ROT tax deduction, we deduct it directly from the invoice and apply for payment from the Swedish Tax Agency (Skatteverket). You are responsible for ensuring that the information you provide is correct, that you are entitled to the deduction and that you have sufficient deduction capacity left for the year in question. If the Swedish Tax Agency rejects the payment in whole or in part for reasons attributable to you, we will invoice you for the amount not paid out.
Your responsibilities as a customer
To allow the work to be carried out as planned, you must ensure that we have access to the property and the roof, and that there is space for scaffolding, materials and a skip. You must also provide access to electricity. Please let us know of any known defects or previous damage to the roof. If the work requires planning permission or other authorisation, you as the property owner are responsible for obtaining it, unless otherwise agreed.
Schedule and delays
We plan the work together with you, and the schedule is set out in the contract. Roofing work depends on the weather, and rain, snow or strong winds may mean the work has to be postponed for safety or quality reasons. We will always inform you as soon as possible if the schedule is affected. Delays caused by circumstances beyond our control do not entitle you to compensation.
Warranty and complaints
For a complete re-roofing, we provide a 30-year watertight roof warranty in accordance with the warranty terms set out in your contract. For other jobs, the warranty stated in the quote and contract applies, along with the manufacturers’ product warranties for installed materials. If you discover a defect, you must notify us within a reasonable time after noticing it. As a consumer, you are entitled under the Consumer Services Act to make a complaint about defects in work on buildings up to ten years after the work was completed.
Cancellation
As a consumer, you have the right to cancel the work before it is completed. In the event of cancellation, we are entitled to compensation for work already carried out, for materials purchased for the job that cannot be used elsewhere, and for other costs caused by the cancellation, in accordance with the Consumer Services Act.
Disputes
If you are dissatisfied with our work, please contact us first so that we can find a solution together. If we cannot reach an agreement, you as a consumer can turn to the National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN). Disputes may also be settled in a general court.
